If his domain name is available (which you can check at some place like register.com, or godaddy.com) then you can purchase it. If it’s not available you can try to contact the competitor that went out of business and attempt to purchase it directly from him. Otherwise you will have to keep an eye on it and after it expires you can purchase it and then have it pointed to your name servers.
